Terms and Conditions

Welcome to PanchDhaga. These Terms and Conditions ("Terms") govern your access to and use of the PanchDhaga website, mobile application, marketplace, vendor services, and related services (collectively, the "Platform").

PanchDhaga is a multi-vendor online marketplace that connects customers with independent vendors offering products and services. By accessing, registering on, or using the Platform, you agree to be bound by these Terms, our Privacy Policy, Cancellation and Refund Policy, and any other policies displayed on the Platform.

If you do not agree with these Terms, please do not access or use PanchDhaga.

Definitions

• “PanchDhaga,” “we,” “us,” or “our” means the operator of the PanchDhaga Platform.
• “User,” “Buyer,” “you,” or “your” means any person who accesses, registers on, or uses the Platform.
• “Vendor” or “Seller” means an independent business or seller listing products or services on PanchDhaga.
• “Product” means any product or service listed by a Vendor on the Platform.
• “Order” means a request placed by a Buyer to purchase a Product from a Vendor.
• “Delivery Partner” means a third-party person or service responsible for delivery or logistics.

Role of PanchDhaga

PanchDhaga provides technology and marketplace services that allow Buyers to discover Vendors and place Orders. Unless expressly stated otherwise, PanchDhaga acts as an intermediary and does not manufacture, own, stock, or directly sell the Products listed by Vendors.

The contract for the sale of a Product is primarily between the Buyer and the relevant Vendor. Product descriptions, prices, availability, warranties, quality, packaging, taxes, and after-sales obligations are the responsibility of the Vendor.

PanchDhaga may facilitate communication, payment processing, order tracking, customer support, and delivery coordination, but this does not make PanchDhaga the seller or manufacturer of any Product.

Eligibility and Account Registration

You must provide accurate and complete information when creating an account or placing an Order. You are responsible for keeping your account details, mobile number, email address, and delivery address updated.

You are responsible for maintaining the confidentiality of your login credentials and for all activity carried out through your account. Please notify us immediately if you believe your account has been accessed without authorization.

We may suspend, restrict, or terminate an account if the information provided is false, incomplete, outdated, misleading, or if the account is used in violation of these Terms or applicable law.

Products, Prices, and Availability

Vendors are responsible for the accuracy of their Product listings, including descriptions, images, specifications, prices, taxes, warranty information, and availability.

We make reasonable efforts to display accurate information. However, errors may occur, and Product availability may change without notice. PanchDhaga reserves the right to correct errors, update information, or cancel an Order affected by an error.

Actual Product colors and appearance may vary depending on your device and screen settings. Product images may be for representation purposes only where clearly indicated.

Orders and Payments

When you place an Order, you are submitting a request to purchase the selected Product from the relevant Vendor. An Order is subject to Vendor acceptance, Product availability, delivery serviceability, and successful payment authorization.

After an Order is placed, you may receive an acknowledgement. An acknowledgement does not necessarily mean that the Vendor has accepted the Order. The Order becomes confirmed when the relevant Vendor accepts it or when confirmation is shown on the Platform.

Payments may be made using the payment methods displayed on the Platform, including cards, UPI, net banking, wallets, or other approved methods. All payments must be made in Indian Rupees unless otherwise stated.

Payment transactions may be processed by authorized third-party payment service providers. You must provide accurate billing and payment information and must not use an unauthorized or fraudulent payment method.

Delivery and Logistics

Delivery is available only in locations that are serviceable at the time of placing an Order. Delivery may be performed by the Vendor, PanchDhaga, or an independent Delivery Partner.

Estimated delivery times are approximate and may be affected by Product availability, traffic, weather, location, holidays, demand, operational issues, or events beyond reasonable control.

Delivery charges, if applicable, will be shown during checkout. Orders will normally be delivered to the address provided at the time of placing the Order. You are responsible for ensuring that the address, phone number, and delivery instructions are correct.

If you are unavailable, provide an incorrect address, refuse delivery, or fail to provide required confirmation or access, additional charges or cancellation may apply.

Cancellation, Returns, Replacements, and Refunds

Cancellation, return, replacement, and refund eligibility depends on the Product category, Vendor policy, Product condition, applicable law, and the circumstances of the request.

You may be able to request a cancellation before the Vendor accepts or processes the Order. Some Products, including food, customised products, perishable items, hygiene products, or products marked as non-returnable, may not be eligible for cancellation or return.

Where permitted, returns may be accepted for products that are wrong, damaged, defective, materially different from the listing, or otherwise covered by the applicable Vendor policy. Products must generally be unused, unopened, and returned with original packaging, accessories, labels, and documentation.

Returns or refunds may be rejected where the product has been misused, installed, altered, damaged after delivery, or returned without required packaging or accessories.

Approved refunds will normally be processed to the original payment method or another permitted method after verification. The time taken for the amount to appear may depend on the payment provider or bank.

For any Order issue, please raise a support request through the Platform or contact us using the details below. False, fraudulent, or abusive claims may result in account suspension and legal action where appropriate.

Vendor Responsibilities

Each Vendor is responsible for complying with applicable laws, maintaining required licences, providing lawful and safe Products, displaying accurate information, fulfilling accepted Orders, issuing invoices where required, and handling warranties or after-sales service applicable to its Products.

Vendors must not list counterfeit, illegal, unsafe, restricted, prohibited, or infringing Products. PanchDhaga may remove listings, restrict stores, suspend accounts, or take other action where a Vendor violates these Terms or applicable law.

User Obligations and Prohibited Activities

You agree to use PanchDhaga only for lawful purposes and in accordance with these Terms. You must not:

• Provide false, misleading, incomplete, or unauthorized information.
• Impersonate another person or misuse another person’s account.
• Use the Platform for resale, unlawful commerce, fraud, or unauthorized commercial activity.
• Upload or share content that is illegal, defamatory, obscene, threatening, harassing, hateful, or infringing.
• Upload viruses, malware, harmful code, or material that may damage the Platform.
• Attempt to gain unauthorized access to accounts, systems, servers, or networks.
• Use bots, scraping tools, automated systems, or similar methods to copy or monitor the Platform without permission.
• Interfere with the security, operation, or availability of the Platform.
• Submit false reviews, fraudulent complaints, or abusive refund or cancellation requests.
• Copy, reproduce, modify, distribute, sell, reverse engineer, or commercially exploit Platform content without written permission.

Reviews, Ratings, and User Content

You may submit reviews, ratings, images, comments, feedback, or other content if it is truthful, relevant, lawful, and based on your genuine experience.

By submitting User Content, you grant PanchDhaga a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, adapt, moderate, and publish that content for operating, improving, and promoting the Platform. You remain responsible for your content.

We may remove or refuse content that is false, abusive, irrelevant, unlawful, promotional, discriminatory, privacy-invasive, or in violation of these Terms.

Intellectual Property

All Platform content, including the PanchDhaga name, logo, design, text, graphics, software, layout, user interface, and trademarks, is owned by or licensed to PanchDhaga and is protected by applicable intellectual property laws.

You may use the Platform for personal and lawful purposes only. No right or licence is granted to use our trademarks, content, software, or branding without prior written permission.

Third-Party Services and Links

The Platform may include links, advertisements, payment services, delivery services, vendor pages, or other services operated by third parties. Their use may be subject to separate terms and privacy policies.

PanchDhaga does not control or guarantee the accuracy, availability, quality, legality, or security of third-party services. You use third-party services at your own risk.

Privacy

Your use of PanchDhaga is also governed by our Privacy Policy, which explains how we collect, use, share, and protect personal information. By using the Platform, you acknowledge that you have read and understood the Privacy Policy.

Disclaimer of Warranties

To the maximum extent permitted by law, PanchDhaga provides the Platform and its content on an “as is” and “as available” basis. We do not guarantee that the Platform will always be uninterrupted, secure, error-free, accurate, complete, or available at all times.

PanchDhaga does not provide warranties regarding the quality, safety, legality, authenticity, availability, suitability, or fitness of Products listed by Vendors. Product-related claims should first be raised with the relevant Vendor, while PanchDhaga may assist with communication where possible.

Limitation of Liability

To the maximum extent permitted by applicable law, PanchDhaga will not be liable for indirect, incidental, special, consequential, exemplary, or punitive losses arising from your use of the Platform or from Products, Vendors, Delivery Partners, payment providers, or third-party services.

Nothing in these Terms limits liability that cannot lawfully be excluded or limited under applicable law.

Indemnification

You agree to indemnify and hold harmless PanchDhaga, its owners, affiliates, employees, officers, service providers, and partners from claims, losses, liabilities, damages, costs, and expenses arising from your breach of these Terms, misuse of the Platform, violation of law, User Content, or infringement of another person’s rights.

Suspension and Termination

You may stop using the Platform or request account closure, subject to completion of pending Orders, payments, refunds, complaints, and other obligations.

We may suspend, restrict, remove, or terminate your access if we reasonably believe that you have violated these Terms, provided false information, engaged in fraud or abuse, created risk for other users, or acted in violation of applicable law.

Termination will not affect rights or obligations that arose before termination or provisions that are intended to continue after termination.

Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated revision date. Your continued use of PanchDhaga after changes are posted constitutes acceptance of the revised Terms. If you do not agree with the revised Terms, you must stop using the Platform.

Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of India. Subject to applicable law, disputes arising from or relating to these Terms or the Platform shall be subject to the jurisdiction of the competent courts in New Delhi, India.

For order-related issues, please first contact the relevant Vendor or raise a support request through the PanchDhaga Platform. You may also contact us using the details below. We will review and respond to complaints within a reasonable period and in accordance with applicable law.
